Article 1 - Service description

MoniTao is an online monitoring and surveillance service accessible at https://monitao.com. The service allows users to monitor the availability of their websites, APIs and automated tasks.

Use of the service implies full and complete acceptance of these Terms of Use.

Article 2 - Access to the service

2.1 Account creation

Access to MoniTao features requires creating a user account. When registering, the user agrees to:

  • Provide accurate, complete and up-to-date information
  • Update this information if it changes
  • Maintain the confidentiality of login credentials
  • Immediately inform MoniTao in case of unauthorized use of their account

2.2 Account responsibility

The user is solely responsible for the use of their account and actions performed from it. MoniTao cannot be held responsible for consequences of unauthorized use of the user's account.

Article 3 - Use of the service

3.1 Authorized uses

The user agrees to use MoniTao only to monitor resources they own or for which they have express authorization. Authorized uses include:

  • Monitoring your own websites and applications
  • Monitoring third-party services with their owners' consent
  • Tracking execution of your scripts and scheduled tasks

3.2 Prohibited uses

The following are strictly prohibited:

  • Using the service to monitor resources without authorization
  • Using the service for load testing or DDoS attacks
  • Attempting to circumvent technical limitations of the service
  • Abusive use of resources (excessive requests, spam)
  • Using the service for illegal activities or infringing third-party rights
  • Unauthorized resale or sharing of services
  • Reverse engineering or attempting unauthorized access to systems

3.3 Technical limitations

Each subscription plan has limitations (number of monitors, check frequency, etc.). The user agrees to respect these limitations. MoniTao reserves the right to suspend accounts significantly exceeding quotas.

Article 4 - Service availability

4.1 Availability commitment

MoniTao strives to keep the service available 24/7. However, MoniTao does not guarantee 100% availability and cannot be held responsible for service interruptions.

4.2 Maintenance

MoniTao may perform maintenance operations that may result in temporary service unavailability. Where possible, users will be notified in advance of planned maintenance.

4.3 Service evolution

MoniTao reserves the right to evolve service features, add or remove them, subject to informing users.

Article 5 - Data and privacy

5.1 Data collected

In the course of using the service, MoniTao collects and processes the following data:

  • Identification information (name, email)
  • Connection data (logs, IP addresses)
  • Monitor-related data (URLs, configurations)
  • Performance data (response times, HTTP codes)

5.2 Data protection

5.3 Data retention

Monitoring data is retained for a variable period depending on the subscription plan. Users can request deletion of their data at any time.

Article 6 - Intellectual property

6.1 MoniTao rights

All elements comprising the MoniTao service (software, interfaces, texts, graphics, logos, trademarks) are the exclusive property of MoniTao or its partners and are protected by intellectual property laws.

6.2 License of use

MoniTao grants the user a personal, non-exclusive and non-transferable license to use the service for the duration of their subscription.

6.3 User data

The user remains the owner of the data they configure on MoniTao (URLs, monitor names, etc.). MoniTao acquires no rights to this data.

Article 7 - Liability

7.1 Limitation of liability

MoniTao provides a monitoring service and cannot be held responsible for undetected incidents, alert delays or consequences related to unavailability of your services.

MoniTao does not guarantee that the service will detect all incidents or that alerts will be delivered instantly.

7.2 Warranty disclaimer

The service is provided "as is" without warranty of any kind. MoniTao does not guarantee that the service will meet the user's specific expectations.

Article 8 - Suspension and termination

8.1 Suspension by MoniTao

MoniTao reserves the right to temporarily or permanently suspend access to the service in case of:

  • Violation of these Terms of Use
  • Abusive use of the service
  • Non-payment of subscription
  • Behavior harmful to other users or the service

8.2 Termination by user

The user may terminate their account at any time from their client area. Data will be deleted within 30 days following termination.

Article 9 - Modifications to Terms

MoniTao reserves the right to modify these Terms at any time. Users will be notified by email of any substantial modification. Continued use of the service after notification constitutes acceptance of the new Terms.

Article 10 - Miscellaneous provisions

10.1 Partial nullity

If any provision of these Terms is declared null, the other provisions shall remain in effect.

10.2 Non-waiver

MoniTao's failure to exercise a right provided for in these Terms does not constitute a waiver of that right.

10.3 Entirety

These Terms constitute the entire agreement between the user and MoniTao regarding the use of the service.

Article 11 - Applicable law and jurisdiction

These Terms are governed by French law. In case of dispute regarding their interpretation or execution, the parties agree to seek an amicable solution. Failing amicable agreement, French courts shall have exclusive jurisdiction.
