Terms of Sale

Article 1 - Purpose

These Terms of Sale govern the contractual relationship between:

  • The Provider: MoniTao, a website and online service monitoring service, accessible at https://monitao.com
  • The Client: Any natural or legal person subscribing to MoniTao services

Any subscription implies unreserved acceptance of these Terms of Sale.

Article 2 - Description of services

MoniTao offers monitoring services including:

  • HTTP/HTTPS Monitoring: Availability and response time verification for your websites and APIs
  • Heartbeat Monitoring: Execution tracking of your scheduled tasks (cron jobs, scripts, backups)
  • Alerts: Email and SMS notifications when an incident is detected
  • SSL Monitoring: Alerts before your SSL certificates expire
  • Domain Monitoring: Alerts before your domain names expire

Article 3 - Plans and pricing

3.1 Available plans

MoniTao offers several subscription plans:

  • Free Plan (€0/month): 1 monitor, 1 heartbeat, 5-minute check interval, email alerts
  • Pro Plan (€49/month): 25 monitors, 10 heartbeats, 1-2 minute interval, email alerts, priority support
  • Business Plan (€89/month): 100 monitors, 50 heartbeats, 30-second interval, email and SMS alerts included, premium support, guaranteed SLA

3.2 Price changes

MoniTao reserves the right to modify its prices at any time. Clients will be notified of any price change at least 30 days before it takes effect. New prices will only apply at the next subscription renewal.

Article 4 - Subscription and payment

4.1 Account creation

To subscribe to MoniTao services, the Client must create an account by providing accurate and up-to-date information. The Client is responsible for the confidentiality of their login credentials.

4.2 Payment methods

Payments are made monthly or annually depending on the option chosen by the Client. Accepted payment methods are: credit card (Visa, Mastercard).

4.3 Invoicing

An invoice is issued and sent by email to the Client with each payment. Invoices are available in the client area.

Article 5 - Duration and termination

5.1 Subscription duration

Subscriptions are taken out for a period of one month or one year depending on the chosen option. They are automatically renewed at their expiration unless cancelled.

5.2 Cancellation by the Client

The Client may cancel their subscription at any time from their client area. Cancellation will take effect at the end of the current subscription period. No refund will be made for the remaining period.

5.3 Termination by MoniTao

MoniTao reserves the right to suspend or terminate access to services in case of:

  • Non-payment of subscription
  • Violation of Terms of Use
  • Abusive or fraudulent use of services

Article 6 - Right of withdrawal

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of services fully performed before the end of the withdrawal period and whose execution began after prior express consent from the consumer.

By creating an account and starting to use the services, the Client expressly waives their right of withdrawal.

Article 7 - Liability

7.1 MoniTao commitments

MoniTao commits to providing its services diligently and according to best practices. MoniTao strives to maintain high availability of its services but does not guarantee 100% availability.

7.2 Limitation of liability

MoniTao's liability can only be engaged in case of proven fault. In any case, MoniTao's liability is limited to the amount actually received for the Client's subscription during the last 12 months.

MoniTao cannot be held liable for indirect damages such as loss of revenue, loss of customers, image damage, etc.

Article 8 - Personal data

MoniTao collects and processes Client personal data in accordance with the General Data Protection Regulation (GDPR). For more information, please see our Privacy Policy.

Article 9 - Intellectual property

All elements comprising the MoniTao service (brand, logos, software, texts, images) are the exclusive property of MoniTao and are protected by intellectual property laws.

Article 10 - Force majeure

MoniTao cannot be held liable for failure to perform its obligations in case of occurrence of a force majeure event as defined by Article 1218 of the French Civil Code.

Article 11 - Modification of Terms

MoniTao reserves the right to modify these Terms at any time. Clients will be notified of any modification by email. Continued use of services after notification constitutes acceptance of the new Terms.

Article 12 - Applicable law and jurisdiction

These Terms are governed by French law. In case of dispute, the parties agree to seek an amicable solution. Failing that, French courts shall have exclusive jurisdiction.
